1. Introduction

Welcome to MzansiMaths, an online Mathematics learning platform owned and operated by Yekhethu Business Venture (Pty) Ltd, trading as MzansiMaths.

These Terms and Conditions of Use ("Terms") govern your access to and use of the MzansiMaths website, learning platform, educational content, subscriptions and related services (collectively referred to as the "Platform").

By creating an account, subscribing to a programme, accessing the Platform or using any of our services, you acknowledge that you have read, understood and agree to be bound by these Terms.

If you do not agree with these Terms, you may not register for an account, purchase a subscription or use the Platform.

Where a learner is under the age of 18 years, these Terms must be accepted by the learner's parent or legal guardian, who accepts responsibility for the learner's use of the Platform.

2. Definitions

Account means the registered learner profile created to access the Platform.

Business Day means any day other than a Saturday, Sunday or South African public holiday.

Company means Yekhethu Business Venture (Pty) Ltd, trading as MzansiMaths.

Content means all educational materials made available through the Platform, including lesson videos, live classes, notes, assessments, worked examples, images, text, graphics and other learning resources.

Learner means any person using the Platform for educational purposes.

Parent or Guardian means a person legally responsible for a learner under the age of eighteen (18).

Platform means the MzansiMaths website, learner portal, learning management system and all related digital services operated by the Company.

Programme means a mathematics course offered for a specific grade level.

Subscription means a recurring monthly paid licence granting access to a selected Programme.

User means any individual who accesses or uses the Platform, including learners, parents and guardians.

3. Acceptance of these Terms

By accessing or using the Platform, you confirm that:

  • you have the legal capacity to enter into these Terms, or are acting through a parent or legal guardian where applicable;
  • the information you provide during registration is accurate and complete;
  • you will comply with these Terms and all applicable South African laws while using the Platform;
  • you understand that continued use of the Platform constitutes acceptance of these Terms, as updated from time to time.

If you do not agree to these Terms, you must discontinue use of the Platform immediately.

4. Eligibility

The Platform is intended for learners studying Mathematics in accordance with the South African Curriculum and Assessment Policy Statement (CAPS), primarily for Grades 10, 11 and 12.

Individuals who are 18 years of age or older may create an account and subscribe directly.

Where a learner is under the age of 18 years, a parent or legal guardian may register an account, purchase a subscription and accept these Terms on the learner's behalf.

The Company reserves the right to refuse, suspend or terminate access where it reasonably believes that false information has been provided, these Terms have been breached or the Platform is being used for an unlawful purpose.

Part B — Accounts

5. Creating an Account

To access subscription-based services offered through the Platform, users are required to create a MzansiMaths account.

During registration, users must provide accurate, complete and up-to-date information. Users are responsible for ensuring that their account information remains current.

Each account is intended for use by a single learner. Account registration may not be transferred, sold or assigned to another person without the Company's prior written consent.

The Company reserves the right to decline any registration or remove any account where false, misleading or incomplete information has been provided.

6. Parents and Minor Learners

MzansiMaths provides educational services primarily to high school learners, many of whom may be under the age of eighteen (18).

Where a learner is under the age of eighteen (18), a parent or legal guardian is responsible for:

  • Creating or approving the learner's account.
  • Purchasing and managing the learner's subscription.
  • Ensuring compliance with these Terms.
  • Supervising the learner's appropriate use of the Platform where reasonably necessary.

Parents and legal guardians acknowledge that educational progress ultimately depends on the learner's participation, effort and commitment.

While MzansiMaths is committed to providing high-quality educational content and academic support, the Company cannot guarantee specific academic outcomes or examination results.

7. Account Security

Users are responsible for maintaining the confidentiality of their login credentials, including their username, email address and password.

Users must take reasonable steps to prevent unauthorised access to their accounts and must notify the Company promptly if they become aware of any unauthorised access, suspected security breach or misuse of their account.

Users remain responsible for all activity that occurs under their account unless they have notified the Company of unauthorised access and have cooperated with any reasonable security measures requested by the Company.

MzansiMaths reserves the right to require password changes, temporarily suspend account access or implement additional security measures where necessary to protect the integrity of the Platform.

8. Single-User Accounts

Each subscription is issued to a single learner and may only be used by that learner.

Sharing login credentials with other individuals, including friends, classmates or family members who are not enrolled under the same subscription, is strictly prohibited.

Users may not:

  • Share usernames or passwords.
  • Allow another person to access lessons using their account.
  • Use another learner's account.
  • Attempt to bypass subscription restrictions or access controls.

Where the Company reasonably believes that an account has been shared or misused, it may suspend or terminate the account without prior notice and without refund, subject to applicable law.

9. User Responsibilities

Users agree to use the Platform responsibly and in a manner consistent with its educational purpose.

Users must:

  • Use the Platform only for lawful educational purposes.
  • Treat educators, support staff and other users with courtesy and respect.
  • Provide accurate information when interacting with the Platform.
  • Comply with all reasonable instructions issued by the Company regarding the use of its services.

Users may not engage in conduct that interferes with the operation, security or integrity of the Platform or negatively impacts the learning experience of other users.

Part C — Subscriptions

10. Subscription Services

MzansiMaths provides access to educational content and related services through recurring monthly subscription plans.

Each subscription grants the learner a limited, non-transferable and revocable licence to access the selected Programme during the active subscription period, subject to these Terms.

Subscription benefits may include, depending on the selected Programme:

  • Access to structured mathematics lessons.
  • Recorded lesson videos.
  • Live online lessons.
  • Practice activities and revision resources.
  • Learner progress tracking.
  • Academic support services.
  • Other educational features made available by the Company from time to time.

Subscriptions provide access only to the Programme selected by the learner unless otherwise stated by the Company.

11. Subscription Fees

Subscription fees are displayed on the Platform before purchase and are quoted in South African Rand (ZAR).

Current subscription pricing is available on the MzansiMaths website and may be updated from time to time. The Company reserves the right to revise subscription fees. Any changes to subscription pricing will apply prospectively and will not affect subscription periods that have already been paid for.

Where required, reasonable notice of pricing changes will be communicated to affected subscribers before the revised fees take effect.

12. Billing and Payment

Subscription payments are collected monthly using the payment methods made available on the Platform.

By subscribing, the user authorises the Company's appointed payment service provider to process recurring monthly payments for the selected subscription.

Payment must be successfully received before access to subscription-based content is granted or renewed.

The Company does not directly process or store customers' full payment card information. Payment transactions are securely processed by authorised third-party payment service providers.

13. Automatic Renewal

Unless cancelled in accordance with these Terms, subscriptions renew automatically at the end of each monthly billing cycle.

The applicable subscription fee will be charged using the payment method provided during registration or subsequently updated by the subscriber.

Subscribers are responsible for ensuring that their payment information remains accurate and valid.

14. Failed or Declined Payments

If a recurring payment cannot be successfully processed for any reason, including insufficient funds, expired payment details or payment authorisation failure, access to subscription services may be suspended until successful payment is received.

The Company may make reasonable attempts to process outstanding subscription payments in accordance with the policies of its appointed payment service providers.

Repeated payment failures may result in cancellation of the subscription and closure of access to subscription-only content.

15. Cancellation of Subscriptions

Subscribers may cancel their subscription at any time through the Platform or by following the cancellation process communicated by the Company.

Cancellation prevents future recurring billing but does not automatically result in a refund of subscription fees already paid.

Where a subscription is cancelled, the learner will continue to have access to the subscribed Programme until the end of the current paid billing period, after which access to subscription-only content will automatically terminate unless the subscription is renewed.

16. Refunds

MzansiMaths is committed to providing high-quality educational services. Due to the nature of digital educational content and immediate access to subscription services, subscription fees are generally non-refundable once access has been granted.

Refunds may, however, be considered in circumstances including:

  • Duplicate or accidental payments.
  • Billing errors attributable to the Company.
  • Unauthorised transactions that are verified following investigation.
  • Where required by applicable South African law.

Nothing in these Terms limits or excludes any rights that consumers may have under the Consumer Protection Act, 2008 or any other applicable legislation.

Approved refunds will, where applicable, be processed using the original payment method within a reasonable period.

17. Promotional Offers

From time to time, MzansiMaths may offer promotional pricing, discounts, free trials or special offers.

Unless expressly stated otherwise:

  • Promotional offers cannot be exchanged for cash.
  • Promotional offers may not be combined with other promotions.
  • Promotional pricing applies only for the promotional period specified.
  • The Company reserves the right to withdraw or amend promotional offers at any time, subject to applicable law.

Part D — Use of the Platform

18. Access to Educational Content

Subject to an active subscription and continued compliance with these Terms, learners are granted a limited, non-exclusive, non-transferable and revocable licence to access the educational content made available through their subscribed Programme.

Access is provided solely for the learner's personal educational use and may not be used for any commercial purpose.

The Company reserves the right to modify, update or remove educational content where reasonably necessary to improve the quality, accuracy or relevance of the Platform.

19. Live Lessons

From time to time, MzansiMaths may provide live online mathematics lessons as part of a learner's subscription.

Live lesson schedules may be updated or amended where reasonably necessary. The Company will endeavour to communicate material schedule changes to affected learners in advance.

Where available, recordings of live lessons may be made accessible through the Platform for subscribed learners.

The Company reserves the right to substitute instructors, reschedule lessons or make reasonable operational changes where necessary.

20. Recorded Lessons

Recorded lessons form part of the educational resources available through the Platform and may be accessed during an active subscription, subject to the learner's subscribed Programme.

Recorded lessons remain the intellectual property of the Company and are licensed solely for personal educational use.

Learners may not copy, download, reproduce, distribute, publicly display or commercially exploit recorded lessons except where expressly authorised by the Company in writing.

21. Learner Responsibilities

Learners are expected to participate responsibly and respectfully while using the Platform.

Learners agree to:

  • Use the Platform for genuine educational purposes.
  • Complete activities honestly and independently where appropriate.
  • Communicate respectfully with educators, support staff and other users.
  • Maintain accurate account information.
  • Protect the confidentiality of their login credentials.
  • Comply with these Terms at all times.

Learners remain responsible for ensuring that they have appropriate internet access and compatible devices necessary to use the Platform.

22. Acceptable Use

Users must not use the Platform in any manner that is unlawful, fraudulent, abusive or harmful to the Company or other users.

Without limitation, users may not:

  • Share account credentials with another person.
  • Impersonate another individual.
  • Attempt to gain unauthorised access to any part of the Platform.
  • Interfere with or disrupt the operation or security of the Platform.
  • Upload malicious software, viruses or harmful code.
  • Engage in conduct that disrupts the learning experience of other users.
  • Use automated software, bots or scraping tools to access Platform content without authorisation.
  • Use the Platform for any unlawful purpose.

The Company reserves the right to investigate suspected misuse and take appropriate action where these Terms are breached.

23. Intellectual Property

All intellectual property rights relating to the Platform and its content remain the exclusive property of Yekhethu Business Venture (Pty) Ltd or its licensors.

This includes, without limitation:

  • Lesson videos.
  • Live lesson recordings.
  • Written lesson notes.
  • Worksheets.
  • Assessments.
  • Graphics.
  • Logos.
  • Branding.
  • Text.
  • Software.
  • Website design.
  • Educational methodologies.
  • All other learning materials made available through the Platform.

Except as expressly permitted under these Terms, users may not:

  • Reproduce or copy educational content.
  • Distribute educational content.
  • Sell or commercially exploit educational content.
  • Upload educational content to third-party platforms.
  • Modify educational content for redistribution.
  • Remove copyright or proprietary notices from educational materials.

Nothing in these Terms transfers ownership of the Company's intellectual property to any user.

24. User-Generated Content

Where the Platform permits learners to submit questions, assignments, comments or other content, users remain responsible for the material they submit.

Users warrant that submitted content:

  • Does not infringe the rights of any third party.
  • Is lawful.
  • Is not defamatory, abusive or offensive.
  • Is relevant to the educational purpose of the Platform.

By submitting content through the Platform, users grant the Company a non-exclusive, royalty-free licence to use, display and reproduce that content solely for the purpose of operating and improving the Platform.

Part E — MzansiMaths Rights

25. Platform Updates and Improvements

MzansiMaths is committed to continuously improving the quality of its educational services and Platform.

The Company may, from time to time and without prior notice where reasonably necessary:

  • Update or improve Platform features.
  • Add, modify or remove educational content.
  • Introduce new functionality or services.
  • Correct errors or inaccuracies.
  • Perform software updates and security enhancements.
  • Make other operational improvements.

Where changes materially affect the services provided under an active subscription, the Company will endeavour to provide reasonable notice where practicable.

26. Service Availability

The Company will use reasonable efforts to make the Platform available on a reliable and continuous basis. However, uninterrupted access cannot be guaranteed.

Access to the Platform may occasionally be interrupted due to:

  • Scheduled maintenance.
  • Emergency maintenance.
  • Software updates.
  • Technical failures.
  • Internet service disruptions.
  • Power outages.
  • Third-party service interruptions.
  • Circumstances beyond the Company's reasonable control.

The Company will make reasonable efforts to restore services as soon as reasonably practicable following any interruption.

27. Suspension of Access

The Company reserves the right to temporarily suspend access to the Platform where reasonably necessary, including where:

  • Subscription payments remain outstanding.
  • These Terms have been breached.
  • Unauthorised account sharing is suspected.
  • Fraudulent or unlawful activity is suspected.
  • The security or integrity of the Platform may be compromised.
  • Suspension is necessary to protect the Company, its users or its systems.

Where appropriate, the Company may notify the affected user of the reasons for the suspension and any steps required to restore access.

Nothing in this clause prevents the Company from taking immediate action where urgent circumstances require it.

28. Termination

The Company may terminate a user's account or subscription where:

  • The user repeatedly breaches these Terms.
  • Fraudulent or unlawful conduct is identified.
  • Subscription payments remain outstanding after reasonable attempts to recover payment.
  • The Platform is used in a manner that materially interferes with its operation or the learning experience of other users.
  • Termination is otherwise permitted by applicable law.

Where an account is terminated due to a breach of these Terms, the learner may immediately lose access to subscription-only content without entitlement to a refund, subject to applicable South African law.

Termination does not affect any rights or obligations that accrued before the termination date.

29. Discontinuation of Services

Although MzansiMaths intends to operate the Platform on an ongoing basis, the Company reserves the right to discontinue all or part of the Platform where reasonably necessary.

Where reasonably practicable, subscribers with active paid subscriptions will receive reasonable advance notice of any permanent discontinuation.

The Company will use reasonable efforts to ensure that subscribers are treated fairly in the event of a permanent closure, taking into account the remaining subscription period and applicable South African law.

30. Communications

The Company may communicate with users regarding their accounts, subscriptions, Platform updates, maintenance notices, payment matters and other important information using:

  • Email.
  • Notifications displayed within the Platform.
  • Any other contact details provided by the user during registration.

Users are responsible for ensuring that their contact information remains accurate and up to date.

Notices sent using the most recent contact information provided by the user will be deemed to have been properly delivered.

Part F — Legal

31. Privacy

MzansiMaths respects the privacy of its users and is committed to protecting personal information in accordance with applicable South African data protection laws, including the Protection of Personal Information Act, 2013 (POPIA).

Personal information is collected, used, stored and processed only for legitimate business purposes, including:

  • Creating and managing user accounts.
  • Providing access to the Platform and educational services.
  • Processing subscription payments.
  • Communicating with users regarding their subscriptions and the Platform.
  • Improving our services.
  • Complying with legal and regulatory obligations.

32. Disclaimer of Warranties

The Platform and its educational services are provided on an "as is" and "as available" basis.

While MzansiMaths uses reasonable care to provide accurate, up-to-date and high-quality educational content, the Company does not warrant that:

  • The Platform will operate without interruption or error.
  • Every lesson or resource will be free from inaccuracies.
  • The Platform will always be available.
  • Use of the Platform will guarantee improved academic performance or specific examination results.

Educational success depends on numerous factors, including the learner's participation, study habits, commitment and individual abilities.

33. Limitation of Liability

To the fullest extent permitted by applicable law, Yekhethu Business Venture (Pty) Ltd, its directors, employees, contractors and service providers shall not be liable for any indirect, incidental, consequential or special damages arising from or relating to:

  • The use of or inability to use the Platform.
  • Interruptions to the availability of the Platform.
  • Technical failures beyond the Company's reasonable control.
  • Loss of data.
  • Loss of profits or business opportunities.
  • Reliance on educational content provided through the Platform.

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful under applicable South African legislation.

34. Indemnity

Users agree to indemnify and hold harmless Yekhethu Business Venture (Pty) Ltd, its directors, employees, contractors and authorised representatives against claims, losses, damages, costs and expenses arising from:

  • The user's breach of these Terms.
  • Unlawful use of the Platform.
  • Infringement of the rights of another person.
  • Misuse of the Platform by the user.

This clause applies only to the extent permitted by applicable law.

35. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any dispute arising from or relating to these Terms or the use of the Platform shall be subject to the jurisdiction of the competent courts of South Africa, unless applicable legislation provides otherwise.

Where appropriate, the parties are encouraged to attempt to resolve disputes amicably before commencing formal legal proceedings.

36. Changes to these Terms

MzansiMaths may amend these Terms from time to time to reflect:

  • Changes in applicable legislation.
  • Improvements to the Platform.
  • Operational requirements.
  • New products or services.
  • Other legitimate business needs.

Where material changes are made, the Company will take reasonable steps to notify users through the Platform, by email or by other appropriate means.

Continued use of the Platform after updated Terms become effective constitutes acceptance of the revised Terms.

37. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be severed from the remaining Terms.

The remaining provisions shall continue in full force and effect to the extent permitted by law.

38. Entire Agreement

These Terms, together with the Privacy Policy, Refund & Cancellation Policy and any other policies expressly incorporated by reference, constitute the entire agreement between the user and Yekhethu Business Venture (Pty) Ltd regarding the use of the Platform.

These Terms supersede any prior discussions, representations or agreements relating to the same subject matter.

Effective Date

These Terms and Conditions of Use become effective on the date published on the MzansiMaths Platform and remain in force until amended or replaced by the Company.
